Terms
Not legal advice. These terms are a plain-language agreement for using QuitSoda’s website and email challenge. They have not been reviewed by a lawyer. If you need legal advice, talk with your own counsel.
Who this is for
QuitSoda is for adults age 18 or older. If you are under 18, do not join the challenge or use the tools.
What QuitSoda is (and is not)
QuitSoda offers general habit education and purchase option guides for adults. It is not medical advice, diagnosis, or treatment, and it is not therapy or coaching for hire. If caffeine, pregnancy, medicines, or a health condition affect your plan, talk with your clinician.
The challenge
Email enrollment costs nothing. You can unsubscribe anytime. Buying anything is never required to take part.
Setup and check-in tools always save your choices on your device first. They save to your QuitSoda profile only when you open them from the signed link in your own QuitSoda email; without that link, your choices stay on your device only. Anyone you forward those email links to could update your saved answers.
Affiliate links
Shopping guides may include affiliate links (including Amazon). QuitSoda may earn a commission if you buy through those links, at no extra cost to you. As an Amazon Associate, QuitSoda earns from qualifying purchases. Product links are suggestions, not requirements.
Your accounts and content
You are responsible for the email address you use, for who can open your QuitSoda email links, and for any notes you choose to save on your device or to your QuitSoda profile. Do not submit illegal, harmful, or infringing content. We may remove or refuse content that abuses the service.
Limitation of liability
To the fullest extent allowed by law, QuitSoda and Patrick McCarthy are not liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or habits-related outcomes arising from your use of the site, emails, or tools. The service is provided “as is.” Total liability for any claim related to the site or challenge is limited to the greater of (a) the amount you paid QuitSoda for the service in the 12 months before the claim (usually $0) or (b) fifty U.S. dollars (US $50).
Indemnity
You agree to hold QuitSoda and Patrick McCarthy harmless from claims arising out of your misuse of the service or your violation of these terms, to the extent allowed by law.
Governing law
These terms are governed by the laws of the State of Oregon, USA, without regard to conflict-of-law rules. Courts in Lane County, Oregon (or the federal district court that includes Eugene, Oregon) are the venue for disputes that cannot be resolved informally, unless applicable law requires otherwise.
Changes
We may update these terms. Continued use of the site after changes means you accept the updated terms. The date below is the last update.
